    Supply, delivery, installation, training and after sales services of a Gas Chromatograph-MS (GC-MS) system for narcotics/NPS

    PROJECT DESCRIPTION
     

    1. Description of the contract

    The purpose of the contract is to supply and deliver equipment to be used by the Central Laboratory to strengthen their ability to detect narcotic substances. This project aims at increasing Moldovan Police's performance in combating Organised Crime. In this context, the purchase of a new Gas Chromatograph, accessories are of paramount importance. The equipment should be provided together with the installation, the training of the personnel and provided extended warranty support.

    3. Eligibility and rule of origin

    For this contract award procedure, participation is open to invited tenderers only. 

    Rule of origin is not applicable to the current procedure.

    4. Number of offers

    Tenders for only part of a lot will not be considered. Tenderers may not submit a tender for a variant in addition to their tender for the supplies required in the tender documents. In the case of a variant, the evaluation will take place without the variant.

    5. Situations of exclusion

    Tenderers must provide a signed declaration, included in the tender form for a supply contract, that they are not in any of the situations listed in point 2.2.2 of the Guide to Procurement Procedures and Contract Award Rules of CIVIPOL.

    6. Subcontracting opportunities

    Subcontracting is authorised.

    7. Performance guarantee

    The successful tenderer will be required to provide a performance guarantee equal to % of the value of the contract on signature of the contract. This guarantee must be provided with the countersigned contract within 15 days of the tenderer's receipt of the contract signed by CIVIPOL. If the successful tenderer fails to provide the required guarantee within the stipulated period, the contract will be null and void.

    8. Information meeting and/or site visit

    A virtual information meeting will be organised online on  15th July 2026 at 14:00 CET  with a view to presenting the tender documents answering questions on the tender dossier sent in writing or raised at the meeting. 

    Tenderers willing to attend the meeting should address their request to procurementEU4FAST@experts.civipol.fr so that they can be invited to participate in the meeting. The minutes of the meeting will be notified and available for download by email notification to all tenderers who have downloaded the tender dossier via the platform e-marchespublics.com - together with any clarification of written questions not raised at the meeting - no later than 14th August 2026 at 18:00 Paris time. No further clarification will be provided after this date. All costs associated with attending this meeting will be borne by the bidders.

    9. Validity of offer

    This offer is valid for a period of 60 days from the deadline for submission of offers. In the event that the contract is awarded to our entity, we confirm that our offer will remain valid until an export licence for the equipment has been granted by our national authorities (if applicable) and the contract can be duly signed.

    SELECTION AND AWARD CRITERIA

    12. Selection criteria

    Capacity-providing entities

    An economic operator (i.e. candidate or tenderer) may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links it has with them. If the economic operator relies on other entities, it must in that case prove to the contracting authority that it will have at its disposal the resources necessary for the performance of the contract by producing a commitment by those entities to place those resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality as the economic operator relying on them and must comply with the selection criteria for which the economic operator relies on them. Furthermore, the data for this third entity for the relevant selection criterion should be included in a separate document. Proof of the capacity will also have to be provided when requested by the contracting authority.

    With regard to technical and professional criteria, an economic operator may only rely on the capacities of other entities where the latter will perform the tasks for which these capacities are required. 

    With regard to economic and financial criteria, the entities upon whose capacity the economic operator relies, become jointly and severally liable for the performance of the contract.

    The following selection criteria will be applied to the tenderers. In the case of tenders submitted by a consortium, these selection criteria will be applied to the consortium as a whole if not specified otherwise. The selection criteria will not be applied to natural persons and single-member companies when they are sub-contractors.

    1. Economic and financial capacity of the tenderer (based on item 3 of the tender form). In case of tenderer being a public body, equivalent information should be provided. The reference period which will be taken into account will be the last three financial years for which accounts have been closed.

    The selection criteria for each tenderer are as follows:

    • the average annual turnover of the tenderer must exceed 250.000 €

    2)         Professional capacity of the tenderer (based on items 4 of the tender form).

    The reference period which will be taken into account will be the last three years preceding the submission deadline.

    • at least 2 staff currently work for the tenderer in fields related to this contract (provision and/or training on high level laboratory equipment).
    • the tenderer shall demonstrate that its key technical personnel responsible for the installation, commissioning, maintenance and user training of the proposed equipment have successfully completed technical training provided by the manufacturer of the proposed equipment.

      Evidence to be provided: Copies of valid training certificates issued by the manufacturer, or equivalent documentary evidence demonstrating successful completion of the manufacturer's technical training programme.

    3)         Technical capacity of tenderer (based on items 5 and 6 of the tender form). The reference period which will be taken into account will be the last five years preceding the submission deadline.

    • the tenderer must have delivered similar supplies (Analytical laboratory equipment) under at least 2 contracts each with a budget of at least 100.000€ which were implemented at any moment during the following period: 2021 to date.

    This means that the contract the tenderer refers to could have been started at any time during the indicated period but it does not necessarily have to be completed during that period, nor implemented during the entire period. Tenderers are allowed to refer either to supply contracts completed within the reference period (although started earlier) or to supply contracts not yet completed. Only the portion satisfactorily completed during the reference period will be taken into consideration. This portion will have to be supported by documentary evidence (statement or certificate from the entity which awarded the contract, proof of payment) also detailing its value. If a tenderer has implemented the supply contract in a consortium, the percentage that the tenderer has successfully completed must be clear from the documentary evidence, together with a description of the nature of the supplies provided if the selection criteria relating to the pertinence of the experience have been used.

    Previous experience which would have led to breach of contract and termination by a contracting authority shall not be used as reference.

    15.       Deadline for submission of tenders

    Any offer received after the deadline will not be considered.

    16.       Opening of tenders

    Tenders will be opened online in public on 24th August 2026 at 14h00 Paris time by the committee appointed for this purpose. Minutes will be taken by the committee and will be available on request. Tenderers willing to participate in the online public opening should address their request to procurementEU4FAST@experts.civipol.fr so they can be invited.

    Any attempt by a tenderer to influence the evaluation committee in the procedure for examining, clarifying, evaluating and comparing tenders or to obtain information on the conduct of the procedure or to influence Civipol in its decision on the award of the contract will result in the immediate rejection of the tender.
